The Biden-Harris administration is under scrutiny after a watchdog group filed a complaint claiming the Department of Health and Human Services (HHS) violated the Hatch Act by using a Medicare email list to praise Vice President Kamala Harris. The Foundation for Accountability & Civic Trust (FACT) sent its complaint to the Office of Special Counsel, urging an investigation into what it considers an “egregious” misuse of taxpayer resources.
The email in question was distributed in September to Medicare subscribers, highlighting Harris’ involvement in healthcare reforms. Signed by President Joe Biden, the message credited Harris with crucial reforms benefitting seniors and emphasized that the administration believes in making healthcare a “right.”

FACT’s executive director, Kendra Arnold, argued that the message, coming from an official government email address, was political rather than informative. Arnold emphasized that the email list, maintained by the Centers for Medicare and Medicaid Services (CMS), was meant for government communication, not campaign promotion.
Some Medicare recipients voiced their frustration, calling the message “nothing but a campaign ad.” One recipient noted that Harris’ role was emphasized in a way that felt overtly political. The email also highlighted Harris’ tie-breaking vote, crediting her for lowering healthcare costs for seniors.
FACT’s complaint suggests that the use of CMS email lists for political praise of Harris was “outrageous.” Arnold called on the Office of Special Counsel to investigate whether officials violated the Hatch Act, which prohibits federal employees from engaging in political activities while using government resources.
FACT is awaiting a response from the Office of Special Counsel. This Washington-based nonprofit is dedicated to promoting transparency in government and insists that an investigation is crucial to ensure government communication remains free from political influence.
